Enforceability of Environmental Rights: a Possible Panacea to Man’s Environmental Imbroglio - Nigeria’s Niger-Delta as a case study

This research examines how a human rights-based approach has the potency to provide solutions to the avalanche of environmental problems that is bedevilling Nigeria’s Niger Delta. This research took a critical study of the Nigerian environmental legislation and policies, and the reason why, despite the enactment of the environmental provision in Section 20 of the Constitution, there has been and is gross environmental injustice in the country. This research avers that a constitutionally enforceable right to a healthy environment, a full implementation of the African Charter on Human and Peoples’ Rights, the establishment of Environmental Courts and Tribunals (ECTs), comprehensive and quantitative environmental citizen education, as well as empowering environmental NGOs, may be the solution to the current environmental challenges that Nigeria’s Niger Delta as well as the entire country are facing.
